I LOVE RICH and MARAZENE Team Up For Alc O Holiday 2004

Utilizing two different genres of the rock music spectrum, Alex Zander has again combined a couple of complete opposite styles to make his 12th annual Alc O Holiday show a sampler platter of a rock n roll holdiay spectacle.

I LOVE RICH will be premiering totally new songs from their forthcoming album THE YEAR OF THE RICH on Sonic Wave International and will be available worldwide next month. The cover and interior shots were done by KARLTON and features the band as well as viXXXens Diva Deb and Jenni under the direction of Zander. The new album was Recorded and Produced by Andy Gerber (Cheap Trick, Local H).

MARAZENE are making their first ever Alc O Holiday appearance which follows up their very recent successful string of shows at Metro, Double Door and The Bottom Lounge, and are at the top of their game having honed and refined their stage presence and unique sound. 2 years ago MARAZENE drummer Kristov performed as a member of headliners BILE at Alc O Holiday 2002 when it was held at The Cubby Bear.

Super Sexy MY LIFE WITH THE THRILL KILL KULT vocalist and Bomb Gang Girl Sinderella Pussie will be pouring drinks (specials include $4 Makers Mark mixes and $2 select beer ) behind the bar and MK founder/Alc O Holiday Host Alex Zander will be behind the turn tables all night to enhance the mood with a blend of hard rock and Industrial classics, as well as never before heard surprises. Public Access Porn Irks Conservative Activist

AKRON, Ohio - Federal regulations prohibit cable companies from censoring public access stations, much to the chagrin of anti-porn activists in Ohio who are campaigning to have free porn thrown off the air.

The Cleveland Scene reports that while channel-surfing last month, Bonnie Valentine, leader of the fight against porn on public access, discovered hardcore porn on Channel 15, a Time-Warner public access station serving the Akron-Canton region.

"What I saw was intercourse," Valentine told the Scene. "This is beyond obscene. This had crossed into pornography."

As president of Actively Reviving Ohio Communities (ARCO), a conservative activism group, Valentine then vowed to get "public access porn off" of Channel 15. Valentine sent e-mails to Time Warner and a variety of government officials from the Akron City Council to the governor seeking to have public access clean up.

Valentine had landed upon a sex scene shown during Illmatic TV, described as an amateurish variety show that occasionally shows porn clips provided by a friend in Los Angeles that runs an adult video business.

"He would send me some footage of his girls and whatnot," show creator Al Henderson said, telling the Scene that he considered the “previews” to be a public service.

Illmatic TV isn’t the only Channel 15 show that includes the occasional pornographic clip. The channel’s most popular show, The 5 Dolla Half Hour, is mostly about marijuana, but occasionally dabbles in Adult. "We never have full-blown penetration," a producer of the show told the Scene. "But, you know, on the intro, there is a vagina smoking a cigarette."

Another show has topless segments and yet another has hardcore sex scenes, including amateur videos.

Dave Muntean, assistant to the Akron law director, explained why the offending shows couldn’t be forced off the air. “It's a public forum. Neither the city nor Time Warner can edit or make any judgment about the content."

A 1996 Supreme Court decision declared that cable companies could not censor public access programming.

The only thing a cable subscriber who objects to the programming on Channel 15 can do is to have the public access channel filtered out.

Adult programming on Channel 15 is allotted to the "safe-harbor hours," between 10 p.m. and 6 a.m.

Bill Jasso, the vice president of public affairs for Time Warner in Akron, acknowledged that some of the programs on Channel 15 were not suitable for everyone. "Is there programming on that channel that I would not want my daughter to see? Absolutely. And I would take steps as a parent to block out that channel."

Burningangel's Banned Re-Penetrator Back Online Since November 24th

New York - Re-Penetrator, Burningangel.com's zombie-core short porn flick, which was banned a mere 24 hours after its Internet debut, returned in time for Thanksgiving.

Re-Penetrator went live at BurningAngel.com on Monday, October 25th, 2004, just in time for Halloween. The film had tremendous feedback from subscribers; some were thoroughly disturbed and some were strangely
aroused - giving the company pride in their perverted zombie-core production.

After a mere twenty-four hours of having the film on the site, the staff of Burning Angel received a thoroughly disappointing e-mail from their billing company stating the following:

"The Policy Review Department has determined that your account is non-compliant due to depictions of extreme violence. To be more specific, any and all images and/or movies involving blood must be removed from your site."

Re-Penetrator features Burning Angel owner, Joanna Angel, in a parody of the classic 80's horror movie "Re-Animator."

According to Angel, "I never thought that a porno starring a sex-crazed zombie and a perverted mad scientist could be considered as "violence" in the pornographic world. In an industry that thrives off of video clips which display throat gagging, face fucking, and gang banging, I'm not sure why Re-Penetrator, a blatant parody of the 80's horror movie Re-Animator is being forced off the Internet."

The Re-Penetrator is the story of a stripper, who after being dead for 20 years, is resurrected back to life by a perverted mad scientist [Dr. Breast]. Dr. Breast vaginally injects the long dead, but exquisitely preserved, exotic dancer with special serum so the re-penetrated corpse will return from the VIP room in hell and crave nothing but sex. After he injects her with a gooey green potion, the insatiable stripper awakens.

BurningAngel.com is a professional-grade indie porn site run with punk rock attitude. Loaded with music reviews and band interviews, in addition to original hardcore content on the site, burningangel.com began featuring videos of their girls over a year ago. They currently feature 20 videos in their library, however Re-Penetrator is by far their most ambitious project to date. Joanna Angel and the independent film company Backseat Conceptions created the psycho-erotic masterpiece.

For the past year, Joanna Angel has been producing and directing porno shoots at BurningAngel.com. Re-Penetrator marks her first release on the other side of the camera. She currently has two other movies in the works that will be released exclusively on BurningAngel.com in the near future.

Colin Farrell Talks "Miami Vice"

With two little seen indie movies and the quickly panned "Alexander" resulting in not the best year for Irish spunkster Colin Farrell, the boy is now trying something far more mainstream - the Michael Mann-directed, Universal Pictures big screen version of "Miami Vice".

As previously announced, Farrell will play Det. James "Sonny" Crockett and just the other day he spoke with the Chicago Sun-Times about his involvement which is still not locked in - "I'm not trying on those jackets just yet because I haven't signed, although I'd do anything to work with Michael Mann."

Why would Farrell sign on to yet another TV adaptation so soon after "S.W.A.T."? "The script is great. The director is great. The worst thing about the project is the title, but as a piece in and of itself it's brilliant...[It] goes deep into the undercover world. It's Mann doing his heavy and tough stuff, with the kind of great dialogue you saw in 'Heat' and 'Collateral'."

Raimi Writing Spidey 3

Sam Raimi told SCI FI Wire that he and his brother Ivan are still in the earliest stages of writing Spider-Man 3. "We've finished a 50-page document and now I'm working with my storyboard artist to work out some of the visuals," Raimi said in an interview while promoting the DVD release of Spider-Man 2. "And I'm about to start working with Alvin Sargent [who received the "Screenplay by" credit on Spider-Man 2] on the first draft of the screenplay."

Raimi noted that he's still toying around with different possibilities for a chief villain or villains to duke it out with Peter Parker (Tobey Maguire), a.k.a. Spider-Man, in the second sequel. "I actually haven't figured it out just yet," he said. "I'm trying to determine Peter Parker's journey as a human being, what it is that he'll be learning on this next adventure, as a kid growing up, what life lessons [he'll experience]. Once I know what that is, I'm going to try to develop obstacles in his path, like any dramatic writer would do. And out of those conflicts will come the drama. Either he'll be able to overcome these conflicts or he won't. But once I know his journey, and therefore the conflicts that are in his path, I'll choose that villain that best represents those conflicts. That's the way in which I've been approaching this, and I'm still not quite there in determining the villain." Spider-Man 2 arrives Nov. 30 on DVD, while Spider-Man 3 is set for release on May 4, 2007.

Reading the comics, I've always felt that Batman was a very interesting character – at least as interesting as the villains – and I think this film gets back to that. This is an origin story, not a sequel, and the theme of the story is one of realism. We know that Batman doesn't have superhuman powers, but you'll see it in this film, and we find out how the Bat Cave works, where Batman gets his weapons and how the Batmobile really works. The biggest thing is that Batman's the most interesting character in the film.

Viacom, FCC Reach $3.5 Million Agreement

WASHINGTON - Viacom will pay a record $3.5 million to settle dozens of federal investigations into alleged indecency on TV and the radio, and introduce delays in more live programming to help catch troublesome material before it gets on the air.

The settlement, announced Tuesday, closes investigations dating back to 2001. One involved shock jock Howard Stern, and two focused on Opie and Anthony, who lost their Viacom-owned New York radio show after it featured a couple purporting to have sex inside St. Patrick's Cathedral.

Greg "Opie" Hughes and Anthony Cumia went silent after the 2002 show until October, when they joined with XM Satellite Radio, where Federal Communications Commission (news - web sites) regulations don't apply. Stern is joining the Sirius satellite network in January 2006, when his contract with Viacom-owned Infinity Broadcasting expires.

Viacom, which also owns CBS and MTV, agreed to implement a companywide compliance plan aimed at preventing future violations of federal indecency statutes. The plan includes installation of audio delay equipment at radio stations that broadcast live programming and training broadcasters and employees about indecency laws.

"This consent decree allows us to move forward and to focus our efforts in this area by serving our viewers and listeners with techniques to safeguard live broadcasts, such as cutaways and video and audio delays," Viacom said in a statement.

Viacom said the public, not the government, should decide what it is exposed to on radio and television.

But agreeing to the settlement makes that impossible, says John Dunbar, a project manager at the Center for Public Integrity, a nonpartisan government watchdog group. Viacom had a reputation for questioning federal investigations under its former president, Mel Karmazin, who left in June, Dunbar said. Karmazin is joining his longtime associate Stern at Sirius, where he will be CEO.

Becoming more acquiescent with FCC (news - web sites) oversight may make good business sense, Dunbar said, but that means potentially losing freedom of speech.

"Regardless of what the content of the speech was, I'm not sure that it's such a great thing for there not to be a debate on it," Dunbar said.

The settlement is not related to the agency's $550,000 fine against Viacom after the exposure of singer Janet Jackson (news)'s breast during the CBS Super Bowl halftime show in January. Viacom is contesting that fine.

The agreement cancels investigations into about 50 radio and television shows, said Richard Diamond, a commission spokesman. The shows were broadcast by Viacom-owned stations across the country, including some in Florida, Michigan, Ohio, California, Nevada, Pennsylvania, Virginia, Texas, Massachusetts and New York.

The FCC defines indecent programming in the main as containing sexual language or material that is "patently offensive" when measured against prevailing community broadcast standards. It is forbidden on radio or broadcast television from 6 a.m. to 10 p.m. Material that is judged obscene is not allowed at any hour.

Viacom has five days to pay the $3.5 million fine, according to the agreement. Diamond said it was the commission's largest settlement.

Infinity Broadcasting paid fines totaling $1.7 million in 1995 to settle FCC violations by Stern.

RAMMSTEIN Debut At No. 61 On BILLBOARD Album Chart

RAMMSTEIN's "Reise Reise" (Universal) has sold 26,716 copies in the United States in its first week of release (according to Nielsen SoundScan) to debut at position No. 61 on next week's The Billboard 200 chart.

Recorded primarily in Spain (El Cortijo Studio, Malaga), "Reise Reise" (translated as "Voyage, Voyage" or "Journey, Journey") is the follow-up to "Mutter", which entered the chart at No. 77 back in April 2001. Meanwhile, E.TOWN CONCRETE's brand new album, "Made For War" (Ironbound), has registered a 1,666 first-week sales tally. According to the band's vocalist, Anthony Martini, the follow-up to 2003's "The Renaissance" (Razor and Tie) "is a very raw, angry album, and we are all very excited. . . I think a lot of people are gonna be really surprised at the direction we took.

MK Magazine Cuts To The Chase!

I first met MK Magazine founder, Alex Zander, while on tour and was immediately impressed with his cutting yet honest approach toward rock journalism. Both the MK website and magazine are extremely courageous efforts obviously born from a global vision of what real music and entertainment fans live for. There's certainly no shortage of rags that recycle the same empty fluff as their competitors. That's fine for consumers who are more interested in Britney's new wardrobe or "So-and-so's" latest tattoo than the music and personalities of various artists. That is, the ones who actually have their own music and personalities. Enthusiasts, however, realize there's often a difference between popularity and quality. Hey, just because McDonalds is a popular restauraunt doesn't mean the food is good.

MK makes no apologies for going its own way. It's irreverent and cool and funny and I love that! Why talk if you're not going to say something? MK Magazine does say something and I visit the site daily as a result.

MK is for those who have decided it's time to advance their artistic and social awareness past the world of training bras and movie action figures. There's got to be something out there for the rest of us and I'm glad to see Alex Zander filling the void for fans who passed the point of return long ago.

Robin Quivers Gets Daytime Deal

New York- Robin Quivers, the long-time sidekick of radio's Howard Stern, has landed a new gig: daytime TV talk host. Quivers has signed a deal with Sony to develop a one-hour show that could hit screens as early as next fall.

"I'm really excited about this opportunity and have always enjoyed my daily interaction with audiences," Quivers said in a statement. "I look forward to extending that role with daytime television audiences."

Quivers will stay on with Stern while she's developing the show, but whether she could do the talk program and Stern's daily radio show is unknown.

Stern, whose contract with Infinity Broadcasting expires in December 2005, recently signed a $500 million deal with Sirius Satellite Radio. But industry insiders have speculated that he could wiggle out of his Infinity contract early.

Quivers was said to be contemplating a talker a few years ago, but had her hands full with her radio job.

With more than 10 million listeners a week tuning in to "Stern," Quivers is already a household name. And compared to the current crop of daytime talkers, Quivers would bring an "edge" to the field, said Bill Carroll, director of programming for Katz Television Group.

"You're looking at someone who, at least by association, is controversial," said Carroll.

Quivers also has a dramatic history that's all her own, including being molested by her late father and battling depression, a saga she documented in her autobiography, "Quivers: A Life."

A Quivers talk show could bring in the younger audience that advertisers covet, said Carroll.

"The content could be potentially controversial," said Carroll, "which means that it would be aimed at a younger audience. And look at Stern's overall success with the young male audience - which I think also brings with it the young female audience - these things are all pluses in positioning the show."

ROXY SAINT TRANSFORMS TRASH BAGS INTO "TRASH COUTURE"

ROXY SAINT, musician/performance artist/guerilla filmmaker, is launching a
most unusual line of clothing - one-of-a-kind dresses made from black
plastic trash bags, each one designed and painted by Roxy herself. The
anti-fashionista is calling the limited line "TRASH COUTURE," and the first
dresses available, all priced at $55.00 go on sale today at
www.roxysaint.com.

The Los Angeles-based Roxy, who shops at thrift stores and makes or
customizes most of her own clothes, came up with the idea when her wardrobe
was stolen while she was on tour in the U.K. Financially unable to replace
her gear, she got creative and improvised, bought a box of plastic trash
bags at a London market, cut out holes for her head and arms, and used
acrylics to paint a face on the front of the bag. "I really liked the idea
of wearing trash bags," said Roxy, "because they are totally anti-fashion,
and I don't want to be identified by what I wear, but by my music."

Her first trash bag dress was a big hit on stage. Such a hit that the
dresses became an essential and fun part of her wardrobe. That led to
friends and fans asking where they could get her "rubbish wear."

Every one of Roxy's Trash Couture dresses has an original face painted on
it. "Faces fascinate me," Roxy explained. "I've been painting faces since
I was very young because each one is totally unique." As each dress is, in
fact, an original piece of art, some of the few who own one of the dresses
display them on a wall as opposed to wearing them.

The Trash Couture dresses are individually named ("Chaos," "Aquarius,"
"Glitch") and numbered "1/1," and available in various sizes. Dresses made
from large trash bags will come with the bag's original plastic tie to be
used as a belt; Roxy has also used the plastic ties to create a handful of
halter-top dresses.

Roxy Saint, who one journalist described as "PJ Harvey crossed with Sophia
Coppola," has created a formidable buzz in the UK and played the Leeds and
Reading festivals this past summer. Chiefly inspired by Andy Warhol, she is
a DVD-only artist, and her debut release, "The Underground Personality
Tapes," hit the stores November 16. The DVD is a collection of ten songs
and videos that are vibrant and raunchy, and feature cameos by Nick Oliveri
and Josh Homme from Queens of the Stone Age. Already, five of the videos
from Roxy's DVD have been in the Top 30 of iFilm's Top Rock/Pop Videos of
All Time, having logged nearly a half-million "on demand" streams.

Roxy plans to tour the U.S. in early 2005, but in terms of her new-found
career as a dress designer she states, "I've already got my eye on bubble
wrap, aluminum foil, and colored Saran Wrap."

Nine Inch Nail Leaves Interscope, New CD, With Teeth, on Horizon, The Downward Spiral Deluxe Edition CD/DVD, and Rumors of Jeordie White Joining

Trent Reznor and Nine Inch Nails have parted ways with longtime label Nothing/ Interscope. However, their next studio album will be released in the Spring of 2005. The working title of Bleedthrough seems to have been scrapped for the title With Teeth, and if you’re keeping track, that’s “Halo Nineteen.” The band is again working with Alan Moulder, who worked on previous album such as The Downward Spiral and The Fragile.

But here’s the clincher: with A Perfect Circle on hiatus, and Maynard James Keenan headed back to work with Tool, reputable sources tell us Jeordie White (formerly known as “Twiggy Ramirez”) is headed into Trent Reznor's camp, who is currently in in Los Angeles recording the album.

Speaking of The Downward Spiral, a deluxe edition of the CD is due out on November 23rd, 2004. Here are the details from NIN.com:

The two-disc set will feature a redesigned deluxe package which includes a hybrid CD/SACD with the original album in stereo, high resolution stereo, and high resolution 5.1 digital surround sound. This will play on regular CD players as well as SACD players.

Also included is a bonus disc featuring a new compilation of remixes, b-sides, demos, and non-album tracks, including previously unreleased material.

Christian Bale on Batman Begins

The Chicago Sun-Times has published a new interview with Christian Bale talking about the Chicago shoot, the character, and movie.

His Batman kicks butt. "I've never felt like the Batman character in the films was given as much time as any of the villains. The villains were always the most interesting characters, too. Batman has always been this very bizarre, almost blind character running through the middle of the story," Bale says. "Our film is different." Ask him about his Batman and he laughs. "Talk about an American psycho. The guy is running around in a cape."

He will give up a few more on-set secrets. "Our Batman is centered on the early days. It's an explanation. It's certainly not Batman No. 5," he promises. "It's a reinvention. We want you to forget there has ever been a Batman before this one."

Midnight in Chicago on a hot summer night. Batman is cruising Lower Wacker Drive and KAPOW! Some joker -- a motorist not involved in the filming -- swerves into the movie set and sideswipes the Batmobile! Holy fender bender!

"In the middle of the night, a regular civilian guy crashed into the Batmobile. He panicked and later told the cops that he saw us and thought aliens were landing or something. That's how shocked he was to see the Batmobile. His foot just hit the accelerator," says actor Christian Bale, the man who is the new Caped Crusader in "Batman Returns," due out in 2005.

Of the Bat-bashing incident, he muses, "I wonder what this guy will tell his insurance agent. It will go down as one of the classic claims of all time."

Other Bale Bat-nuggets:

* He enjoyed his time in town filming "Batman Returns" last summer, but he didn't appreciate the chafing. "I spent about three weeks in Chicago last July doing night shoots. It's a great city, but the humidity was tough under the Batsuit. Uh, it got a little bad. It's hot enough in the Batsuit, let alone in the Chicago heat."

* He gives Chicago the Mr. Clean seal of approval. "We shot on Lower Wacker, downtown and on rooftops. What shocked me the most is Chicago is such a clean city. I haven't seen a cleaner one except for Australia," he marvels.

* The Chicago cops won't stop you if you're speeding in the Batmobile. "I never got to drive the Batmobile down Michigan Avenue. They were concerned about the proximity of people. I did drive in more remote locations around the city and I went fast. No ticket, but I never got to drive the Batmobile to these places. It was quicker to load it onto a truck than have the Batmobile go screaming through town."

* He got the coveted role of the Caped Crusader by asking for it. "I contacted them. I heard they were doing some low-budget Batman not aimed at kids and I was tantalized," Bale says. "I had appreciated the Batman movies, but I wasn't really a fan and I didn't know the TV series. But I read some of the graphic novels and they were very dark and very interesting." Bale was almost disappointed to find out this Batman film wasn't some low-budget number. "I said, 'It's big-budget, OK, then it won't happen the way I want it to happen. Forget it.' " He changed his mind when he found out that Christopher Nolan ("Memento," "Insomnia") was directing. "We clicked and hopefully we've made something very different."

Howard Stern Promotes Switch to Satellite

NEW YORK - Shock jock Howard Stern, surrounded by strippers and cheered by thousands of fans, began promoting his switch to satellite radio Thursday at a Manhattan rally where he handed out free boom boxes and satellite subscriptions.

"Down with the FCC!" Stern told a legion of sign-waving backers gathered at Union Square. "They have ruined commercial broadcasting."

The fans agreed, screaming "Howard rules!" as their hero addressed the overflow crowd. Stern supporters spilled into the streets surrounding Union Square, stopping noontime traffic throughout the neighborhood.

"Most people think it, but don't say it," said Stern fan Peter Frankel, 50, president of a Long Island janitorial company, as he walked off with a free Sirius boom box. "Howard Stern says it. It's healthy for society."

Across the square on Fifth Avenue, the culture war took on another slant, with fans of the rival satellite radio XM staging their own rally, hoisting placards touting the shock jock antics of its "Opie & Anthony" radio team.

Stern will be able to say anything he wants once he starts at Sirius Satellite Radio, which is free of Federal Communications Commission restrictions. Stern has battled for years with the FCC over the content of his salacious show.

Last month, Stern announced he was leaving traditional radio for Sirius — even though his current syndicated show is scheduled to run through December 2005.

Stern has hinted on his morning program that his January 2006 start date at Sirius could be pushed up. His current employer, Infinity Broadcasting, has ordered Stern to cut back on his on-air references to his move.

Stern, who was scheduled to appear later on "Late Show with David Letterman," left no doubt about his allegiance at the event.

"Once you start listening to (satellite), it's like crack," Stern said to cheers. "You will be addicted."

Stern personally handed out a free Sirius boom box to the first 500 fans, while he had another 20,000 redeemable certificates for free radios. The equipment allows listeners, for $12.95 a month, to receive 120 channels of commercial-free music, sports, news, talk, entertainment and traffic.

The certificates must be redeemed online by Nov. 24, and the redeemers must sign on for a year of Sirius — which would leave them just short of Stern's January 2006 debut. In October, Stern signed a five-year deal with the satellite company worth an estimated $500 million.

Pittsburgh Names Bridge for Warhol

PITTSBURGH - Andy Warhol bridged pop culture and fine arts, so it seems appropriate that his name will grace a span in his hometown.

The Allegheny County Council on Tuesday approved a resolution renaming Pittsburgh's Seventh Street Bridge in honor of the Pittsburgh native and renowned artist.

The span — one of three similarly designed bridges in the city — connects downtown Pittsburgh to the city's North Side, where The Andy Warhol Museum is located.

It was appropriate to recognize Warhol because of the notice and pride the artist and the museum have brought to the county, a resolution sponsored by county councilwoman Brenda Frazier said.

Born in 1928, Warhol grew up and developed his early artistic skills in Pittsburgh. At the center of the Pop Art movement in the 1960s, he turned commonplace objects such as dollar bills and soup cans into works of art. He died in 1987.

Museum officials are considering holding a renaming ceremony in the spring to coincide with the Warhol museum's 10th anniversary.

Ninn Promises 'Unflinching' Examination of Porn Star Life

CHATSWORTH, Calif. - Multiple AVN Award-winning director Michael Ninn latest production promises to offer an “unflinching” look into at the life of a Porn Star.

"This project has been a project I’ve been looking forward to doing for some time,” Ninn said. “This movie will go into the more fragile side of the superstardom that an adult entertainment actress can experience, a side that’s not been fully exposed or explored. This movie will be flattering at times, but above all truthful. It will question what insecurities go through a supernova’s mind.”

The feature, shooting this week in the Los Angeles area, casts Britney Skye as the titular porn star.

“I think the end result will make the performers in this industry very thoughtful. I think they’ll look at their lives and question the same things that I do from this movie,” Ninn said. “With every star, why are people around them? Why are they her friends, and whose interest do they have at heart – mine or theirs? Is the image I’ve become wholly what I want to be? That’s what we’re going to explore.”

Porn Star, scheduled for release in January, will also feature Katja Kassin and Tory Lane. The feature will have five sex scenes, including including two anals and one d.p.

Ninn notes that although Porn Star will still be indicative of his signature style, the movie will be very dark, going back to his roots as opposed to the artistic tone of his more recent work.

Batman Begins Trailer with Ocean's Twelve

Aside from that B.S. deal for Gauge, we still had a great time.

Before Gauge’s stage show, Wankus went into the bathroom and tipped the attendant twenty bucks so he could use some hair gel. He proceeded to take the goop and slide it in his hair, slicking it back as New Jersey grease ball as he could make it. He then unbuttoned his shirt so low that he looked like he was trying out for the Sopranos. The scary thing is, when he came out of the bathroom, in that environment, he didn’t look so out of place. (laughs)

Gauge took to the stage and looked stunning. She had on a short black wig and we all felt that she looks great with that hair color and style. It was very vogue.

The first part of her act was very dance oriented where she moved and shaked her sexy hips, tits and more. She gave a lot of attention to the screaming audience and really knew how to draw them in with her pole moves, pussy teases and stage crawls.

As her act when on, Gauge became much more playful, not only throwing out posters and funny prizes like Vaseline, mini-purses for the ladies filled with condoms and sexy calendars, but at one point she brushed her breasts with red and blue paint, then pressed them against T-Shirts that she gave out to screaming fans. The funny part about that wasn’t the t-shirt design, but when she gave the shirts to fans she rubbed her tits in their face and perhaps so happy about being so close to her breasts, they didn’t even notice that their faces were covered in paint! [“Really officer, I wasn’t drinking at all tonight.”] LOL

“My cast and crew are really why my features get nominated… I have incredible videographers, incredible editors, and all my support is what makes these features get noticed,” says Ninn. “Garden was just a magical picture and everything came together with it. We never set out to make something to win an AVN award, we just make pictures that people will like and buy, so the nomination comes as a pleasant surprise. It does my heart good that other people recognize how talented my crew is.”

Following Ninn Worx’s nominations is Private with 18 nods, including 10 for their high-budget feature Millionaire, which was recognized in such categories as Best Foreign Feature, Best Director – Foreign Release and Best Screenplay. Meanwhile, Seymore Butts grabbed a nomination for Best Gonzo Series as well as an induction into the Hall of Fame, and his hit Showtime reality series, Family Business, was nominated for Best Alternative Release for the first season box set. Seymore’s cousin, Cousin Stevie, also gained a couple of nods for his brand new series Cousin Stevie’s Pussy Party: one for Best All-Girl Feature (for the second volume), and another for Best All-Girl Series.

“The only thing that could get me more excited would be shooting eight naked women having sex… next to that, this is the most exciting thing I can think of,” Stevie says. “You know, I am so fuckin’ proud and happy. I didn’t expect this at all – I didn’t think it’d make final nominations. I feel that this shows people are at least accepting the concept I came up with for Pussy Party.”

Suze Randall Productions kicked off the year right , starting their new company by staggering new releases with old classics Suze shot in the late 70s and early 80s. So it’s no coincidence that both new and old titles garnered nominations, with Dark Side recognized in the Best All-Sex Video category and Sky Foxes for Best Classic Release. Dark Side also got Suze and her daughter Holly noticed for Best Director – Non Feature.

I think this is great because it’s our first year back in video,” Holly says. “We got off to a rocky start and to be nominated already for four awards… I’m pleasantly surprised. I honestly don’t expect to win because we’re going up against such heavy hitters as Laurent Sky, Jules Jordan and Toni English who have been directing in this industry for so many years. Not to say that we won’t win in the future, but being that this is the first year I’m just happy to be nominated.”

Rounding out Pure Play’s nominations is Score Group with a few nods, including Best Amateur Release for Naughty Neighbors Amateur Couples, Simon Wolf Productions flexing its creative muscle and getting noticed for it with a nom for Best Special Effects in Blue Angels: The Second Coming (as well as recognition for Best Ethnic Themed Release – Asian for A Taste of the Orient), and Erotic Media’s nomination for Decadent Love in the Best Foreign Feature category.

ROXY SAINT Debut Land In Stores Tomorrow

As far as we're concerned Roxy Saint IS the next big thing, and if there's any justice in the world she will be.

Hitting stores everywhere tomorrow is The Underground Personality Tapes the debut DVD album from musician, artist and guerilla filmmaker, Roxy Saint. It is a collection of 10 new songs and digital videos connected by surreal interstitial segments that portray character creations from Roxy's life and experiences living on the edge of reality. She's part Cindy Sherman, part Punk Rock Queen, and the rest sexual provocateur. Surrounding herself with film kids, musicians, and at least 3 or 4 beautiful girls, she acts as both catalyst and glue. When asked about the girls, Roxy reasons, "Keith Richards always had beautiful women around him so, I figured I'd get some too."

The DVD uses uncensored visual content attached to a strong lyrical, and metaphorical subtext -which in itself is a seditious act of art against the corporate constriction of creativity. For Roxy, the creation of a digital video becomes a renegade act of outsider art. "There's never any money, and usually no crew, I utilize anything or anyone that's readily available," she says. "It's guerilla meets dogma filmmaking." The upside is that there are no rules, no asking permission, and no censorship.

Inspired by Andy Warhol, David Lynch (Blue Velvet), Hazel O'Connor (Breaking Glass), and the Harmony Korine film, Gummo. The project was produced independently and on the fly, 100% guerilla street film 100% digital. The songs were recorded in the bedroom, the videos were shot in the bathroom, and edited on a borrowed first generation Apple G4 in the living room. Roxy's underground style brings us full circle back to a time when the role of artists was to challenge the norm by attaching ideas to actions and rising up from the street.

Roxy is currently developing new concepts, and songs for another DVD, having "Spend The Night" parties with the girls and preparing for her US, European, and Japanese tour dates. SOIL Announce New Singer

Chicago's SOIL have announced the addition of DIESEL MACHINE frontman AJ Cavalier to the group's ranks. "AJ originally hails from NY and was recommended by some very close friends," the band write on their web site. "Once he came to rehearsal to jam and lay down some rough demos with us, we knew he was the man for the job. We are currently writing the new album and preparing to get ready for the new chapter of SOIL. It feels great to be a full band again. AJ is everything we were looking for and wanted in a singer. We know the SOIL army will welcome him with open arms."

SOIL, who recently split with J Records, are expected to release the follow-up to this year's "Redefine" in late 2005 through an as-yet-undetermined label.

VAN NUYS--Legendary male performer and Metro contract star Ron
Jeremy has become the newest spokesperson for PETA (People for the
Ethical Treatment of Animals).

Jeremy's first project for PETA was being photographed nude in bed
while holding a 91/2 inch ruler, a clear reference to Jeremy's penis size.
Jeremy was photographed by Robert Sebree and will appear in PETA's
national campaign ad titled, "Too Much Sex Can Be A Bad Thing," which
humorously promotes the spaying and neutering of animals.

Kristin Herman, Special Projects Coordinator for PETA said the irony of
using a male pornstar to appear in the new campaign would grab
people's attention toward the cause.

"When we first came up with the tag line 'Too Much Sex Can Be a Bad
Thing' Ron was the first person who came to all of our minds," Herman
said. "Even if I was the only one to admit it! Ron is a big softie."

Jeremy is passionate about devoting time to the cause.

"It's a necessary organization," Jeremy said. "People complain about the
pound killing the animals that aren't claimed but yet do nothing to spay
or neuter their animals."

Jeremy joins PETA's other celebrity spokespeople such as Carrie Otis,
Traci Bingham, Elizabeth Berkley, Pamela Anderson and Anna Nicole
Smith.

"I love following in the footsteps of Pamela Anderson and my friend Traci

Free Tommy Lee concert falls flat as attendees flee early

A free thank-you concert, courtesy of Tommy Lee’s TV entourage, turned out to be less about music and more about TV.

Crowds waited impatiently outside the Rococo Theatre for more than an hour, comparing Tommy stories of retakes and staged antics.

“Right now I’m asking myself why I’m standing in line this long to see Tommy Lee,” said freshman art major Eric Chloupek.

Outside the door, a sign stated that entering the theater granted filmmakers the right to use students’ images “throughout the world in perpetuity.”

“Make this unbelievable for TV,” Lee said when he took the stage. “Trust me when I say this, the whole world is watching.”

Holding a microphone before a bullhorn he said, “Let’s show these people all around the world what’s going on in Nebraska. Don’t let me down. They’re all watching.”

Thanking Chancellor Harvey Perlman, who stood on a balcony above the stage, Lee professed he was having an emotional moment. Then he thanked the audience, his roommate, his band, and once again asked, “Can we make this amazing for TV?”

The crowd cheered before the stage, on which Lee, recording artist B.T. and another disc jockey stood. Playing a cover of Beastie Boys’ “Fight For Your Right,” the University of Nebraska-Lincoln drumline entered the stage, and the horns of the marching band entered the audience.

The chancellor smiled and tapped the banister to the music.

The crowd by the stage held their arms up in the pulsing lights. Four dancers writhed on stage.

A camera pivoted over the stage and men holding lights walked across, following other men holding cameras.

Lee played drums, danced on the stage, took his shirt off and talked to the crowd.

At the end of the song the drumline threw their sticks into the audience.

Then the drumline asked for them back, because producers wanted to film another take.

So the sticks were thrown back and cameras resumed again, with the marching band entering stage left and right, sweating now.

A few minutes later, for the third time, the sticks were thrown back.

Though B.T. and Lee asked for the sticks back once more, many audience members refused.

Conrad Castaneda, a senior history major, compared it to a pep rally and left.

“Man, this is lame,” Castaneda said. “No rock ’n’ roll. I thought I was gonna come see Tommy Lee play with a band.”

By then, many in the estimated audience of 650 had emptied out of the theater. One of the producers said another 40 minutes of music was planned.

“We’re just gonna do some mixes, have some fun, let loose,” he said.

Shot Shows Promise As Male Contraceptive

WASHINGTON - The world of male contraception has been limited to condoms and vasectomies. But researchers now point to a new method that shows promise — a shot that prompts an immune reaction to a protein produced in the male reproductive system.

The method worked in experiments on male monkeys, most of which regained their fertility when the treatments were stopped, researchers report in Thursday's issue of the journal Science.

"Immunocontraception for males is a possibility and hopefully will be developed for human use over the next several years," said Dr. Michael O'Rand of the University of North Carolina.

O'Rand, lead researcher in the project, said that progress depends on funding for the work and that even with unlimited money, translating the findings into human use could take a decade.

"This is a proof of principle. It could be adapted for human use with continued development and the appropriate safety-toxicology tests," O'Rand said.

Nonetheless, the success in monkeys does indicate a new possibility for male contraception.

In recent years, researchers have developed some male contraceptives, based on hormones, that were designed to suppress sperm production. This work is now in trials.

In O'Rand's experiments, which did not involve hormones, monkeys were immunized using a form of eppin. That is a protein produced in the testis and epididymis, the tightly coiled ducts that carry sperm.

Male monkeys that developed a strong immune response to the eppin were still able to copulate but could not impregnate females, the researchers said.

"We don't understand the exact mechanism yet, but we think the immunocontraception works by preventing the sperm from freeing itself from the seminal fluid to make its way to the uterus and oviducts to fertilize the egg," O'Rand said.

In the experiments, designed in the United States and carried out in India, seven of the nine males tested developed high antibody levels. Five of the seven recovered fertility once the immunization stopped. They were injected with eppin about every three weeks to maintain the immunization.

Dr. Patricia Anastasia DeLeon of the University of Delaware said the results were significant and that scientists were lucky to get a protein that would produce antibodies.

Normally the body does not produce antibodies against its own proteins, she said. But, DeLeon said, the testis and epididymis are protected by a barrier so the protein never gets into the bloodstream. So, when eppin was injected into the bloodstream the immune system did not recognize it and produced antibodies.

"I think it's significant because the reversibility is very attractive," said DeLeon, who was not part of the research team.

The findings are valid and interesting, said Douglas S. Colvard, associate director of CONRAD, a cooperative organization based at Eastern Virginia Medical School in Norfolk, Va. The group organizes and funds contraceptive development research, including O'Rand's project.

Colvard said that what needs to be done now is to repeat the experiment in other animals or in more monkeys. He also said researchers need to show that what happened in monkeys is likely to occur in humans, too.

Colvard said that while O'Rand's findings demonstrate a target for a potential male contraceptive, he believes hormone-based male contraceptives are closer to reaching the market. Indeed, he said, two major European drug companies are currently collaborating to develop such products.

The A&E "Biography" episode on KISS bassist/vocalist Gene Simmons is set to premiere on Wednesday, December 8, 2004 at 10:00 p.m. ET.

Laibach Add Second Chicago Show For This Weekend

LAIBACH RELEASES ANTHEMS DOUBLE CD AND TWO DVDS TO COINCIDE NORTH AMERICAN TOUR

Laibach will tour North America this fall in support of three releases: Anthems double CD (Oct. 5, 2004), The Videos DVD (Nov. 16, 2004), and A Film from Slovenia - Occupied Europe NATO Tour 1994-95 DVD (Dec. 14, 2004 TBC). This is the first North American tour in over six years.

This tour was scheduled deliberately for after the Presidential election. When asked why Laibach are touring now, Ivan Novack (spokesperson) responded, "Laibach have decided to tour straight after the election to comfort the defeated part of the American nation and to unite the divided sides into an expression of a static totalitarian cry."

Anthems will be released as a double CD with a booklet encased in a perfect bound book. CD1 of the album is a collection of the best of Laibach's anthemic songs including previously unreleased material while CD2 will contain mixes, some of which are unavailable elsewhere. The 40 page booklet containing paintings, photographs and writing on the band by Alexei Monroe.

The Videos DVD contains a collection of the best videos spanning Laibach's career plus the EPK from their last album, WAT (2003) as a bonus. The DVD will also contain the video for new single from WAT called, "Das Spiel Ist Aus."

The New York Times described Laibach as, "an art-and-politics collective using music as a vehicle for turning the masses away from capitalism, Christianity and the entertainment business and toward its own ideals of brutism, crypto-totalitarianism, industrial art and Neue Slowenische Kunst, which is the name of both the art collective the band belongs to and of the apocryphal state it has established."

Marlon Brando's Son Implicated In Michael Jackson Child Abuse Case

SANTA MARIA, United States (AFP) - A son of late acting legend Marlon Brando was implicated in an alleged plot by Michael Jackson to kidnap the boy who accused him of child molestation, a court heard

The bombshell was dropped during a pre-trial hearing in Jackson's child molestation case when prosecutors revealed they had recently discovered documents linking Miko Brando with the alleged crime.

Brando, 44, the son of the Oscar-winning movie giant, works as a security guard for the "King of Pop" and received a 20,000-dollar petty cash payment from Jackson, prosecutor Ronald Zonen told Judge Rodney Melville.

A record of the alleged December 2003 transaction was discovered in documents seized in a search of the home of Jackson's personal assistant, the court heard.

"Evidence of the movement of cash (is) consistent with count one of the indictment" against Jackson, Zonen told the court as prosecutors and Jackson's lawyers haggled over what evidence should be allowed at trial.

Count one on the 10-count criminal indictment is that Jackson and his alleged co-conspirators planned to abduct a child, to falsely imprison someone and to extort someone.

While details of the indictment remain secret under a strict gag order in the case, the charges are thought to involve an alleged plot to abduct Jackson's young accuser, his younger brother and the boys' mother.

But Jackson lawyer Robert Sanger, arguing that the financial record should not be seen by Jackson's trial jury, said the payment proved nothing.

"There is nothing unusual with someone like Michael Jackson, with such a large operation like Neverland, to have 20,000 dollars in cash delivered to them for the purpose of running their daily affairs," Sanger said.

Jackson's legal team wants a battery of documents seized from the home of Jackson's personal assistant ruled inadmissible as evidence at trial, while prosecutors are fighting to have it included.

Also among the seized documents that the two sides sparred over Friday was what prosecutors said was evidence that Jackson had "orchestrated" demonstrations by fans outside the courtroom in Santa Maria, California.

Jackson has turned up in court several times since January and thousands of screaming fans have also appeared to support their hero against what they say are false allegations against him.

Another of the disputed sets of documents Jackson's lawyers want kicked out of evidence is a calendar indicating Jackson, 46, was at his Neverland ranch when certain material was downloaded off the Internet that prosecutors said could corroborate evidence that will be given by Jackson's accuser.

Judge Melville said he would rule on whether the various items would be admitted into evidence at Jackson's trial, due to start here on January 31, but said he was not inclined to admit evidence of Jackson's alleged involvement in organising demonstrations in support of him as it appeared irrelevant.

Jackson is charged with molesting a 12-year-old boy at his Neverland Ranch, near here, in February and March of last year. He was arrested on November 19, 2003 and freed on three million dollars' bail.

In April, he pleaded innocent to charges including child abuse, plying a minor with alcohol and conspiring to kidnap, illegally imprison and extort his alleged victim or his family.

The judge, growing impatient at one point during the second day of a two-day pre-trial hearing on Friday, said he was determined that jury selection should begin in the trial on January 31.

At one point Melville cut Sanger off, saying: "You notice how grumpy I get at 4:30 in the afternoon. It's a good time to shut up," he said ordering both sides to properly share information with each other.

The next hearing in the case is likely to be November 22.

"In September of 2004, the world of metal was shocked when the news was unveiled that Lemmy, MOTÖRHEAD's veteran frontman, had sustained an injury to his foot severe enough to cause the band to cancel their much anticipated tour of the United States. Lemmy had managed to get an infection on his foot from an injury sustained on an earlier show. Ignoring doctors' orders, Lemmy forged ahead and finished the highly successful string of European festival dates. 'MOTÖRHEAD fans are the best fans in the world and they deserve everything I have to give,' Lemmy waxed, 'and I am going to do whatever I can to play the shows. F**k the doctors!' The band went on to play to thousands of fans, bring classics and new songs alike to the hungry metal heads!

"The shows were a success, but the infection in Lemmy's foot grew to the point that some serious medical decisions had to be made. On the eve of the band's much-anticipated U.S. tour, doctors advised Lemmy that the infection was so severe that they suggested amputating a part of his foot to stem the spread. Lemmy told the doctors where they could stick their diagnosis and decided to head back to his native home of England and consult his physicians there. The battle of the bold-faced blondeshells erupted when Reid's left breast popped out of her gown outside Cipriani Wall Street Thursday night. As paparazzi clicked away merrily, an oblivious Reid continued to pose. But her smile turned into a grimace when she realized her breast was exposed after a handler ran over and frantically pushed her fallen strap back onto her shoulder.

A red-faced Reid told PAGE SIX yesterday: "I took off my jacket and my strap fell off. It was awful. The photographers were like lunatics — high-fiving each other in front of me. It was so embarrassing. There were so many paparazzi and the flashbulbs were going off, I couldn't see anything.

"I didn't even know what was happening. I was like, 'It's not nice to take a picture like that. Please don't print the picture,' but they just laughed."

The pixie actress seemed exasperated by this latest burst of bad press: "I'm known as this retard . . . I want to grow up. I don't want to be the drunk girl. It hurts my feelings when you guys write stuff about me. It's not just me — it affects everyone around me. I just want everyone to leave me alone — let me graduate. Reid swears she has changed her wild ways: "I'm not crazy anymore. I'll be 29 on Monday and am celebrating at my mom's house in New Jersey. I didn't do anything. Paris seems to be able to move on from situations all the time, why can't I?"

Naked Man Jumps On Plane At LAX

LOS ANGELES (Reuters) - A Canadian man, angry that he was refused a plane ticket to Australia at Los Angeles International Airport, stripped naked, sprinted across the tarmac and climbed into the wheel well of a moving jumbo jet, officials say.

Pilots of the Qantas Airways flight stopped the plane. The man was coaxed out of the wheel well and arrested for trespassing, said airport spokeswoman Nancy Castles.

"This was an extremely dangerous thing for him to do. If he had continued to cling in there with the aircraft taking off at over 200 miles (320 kph) per hour, he might have fallen out and could have been sucked up by an engine," she said.

"If he had survived that and was in the wheel well when the landing gear was retracted, he could have been crushed by the mechanism. And if not he very likely would have frozen to death during the 15 1/2 hour flight at 30,000 feet (9,150 metres) while wearing no clothes."

The man, Neil Melly, 31, tried to buy a one-way ticket on the Qantas flight on Monday evening, but was turned down because he could not supply a valid credit card, Castles said.

Later, he managed to climb over an airport fence, topped by three strands of barbed wire, without injury and was spotted by a ramp worker "running, naked, full-speed" toward the plane.

Castles said a check by authorities found that Melly had been reported missing to the Royal Canadian Mounted Police and was suffering from bi-polar disorder, a manic-depressive illness.

AVN Award Nominations Announcement Set

CHATSWORTH, Calif. - Nominations for the 2005 AVN Awards will be announced one week from today, on Friday, November 12.

The nominations will be posted on AVN.com at 2 p.m. Pacific time.

AVN senior associate editor Heidi Pike-Johnson said, "Companies need to send their product in to my attention as soon as possible so that everyone voting has plenty of time to view everything being considered. I cannot stress the urgency of getting these titles here promptly strongly enough."

Companies with nominations in the following categories must submit 30 copies of each title on DVD: Best Film, Best Video Feature, Best Gonzo Release, Best Sex Comedy, Best All-Sex Release and Best DVD.

Nominees in all other categories must submit 20 copies of each title on DVD. Companies with series under consideration should send representative volumes of the series that were released during 2004.

Nominations will then be reviewed for consideration by AVN's editorial staff and freelance reviewers, who will determine who the winners are by their votes.

Winners will be announced at the 22nd annual AVN Awards show, to be held on January 8, 2005, at the Venetian Hotel in Las Vegas.

NINE INCH NAILS mastermind Trent Reznor has commented on the re-election of President George W. Bush via posting on the group's web site. "One step closer to the end of the world," he writes. "The one-two combo of corporate greed and organized religion apparently proved too much for reason, sanity and compassion. It's a sad and shameful day to be an American."

NINE INCH NAILS have set "With Teeth" as the title of their new album, tentatively due in March 2005. The follow-up to 1999's "The Fragile", which previously carried the working title of "Bleedthrough", is currently being mixed with Alan Moulder (THE CURE, SMASHING PUMPKINS) and the final track listing is being discussed and determined, according to a posting at the group's official web site.

"With Teeth" was recorded in part at Sound City Studio in Van Nuys, Ca., and features a guest appearance on drums by former NIRVANA drummer/current FOO FIGHTERS frontman Dave Grohl.

Ashcroft to Resign ?

Fox News has reported that Attorney General John Ashcroft will resign from President Bush's administration in two weeks.

It has been widely rumored the former NY mayor Rudolph Giuliani could replace him. However, it seems tis is only a rumor.

Ashcroft has been a pain in the ass of the adult industry since he became attorney general. The industry will be very happy if in fact he does resign, but don't expect a major shift in the Justice Department's stance toward the industry.

It should be noted that during the time Giuliani was mayor of New York, he waged a battle against adult book stores and was successful in closing many of them.

Names that have been floated in recent weeks as a possible replacement include Ashcroft's former deputy, Larry Thompson, who would become the first black attorney general. Others include Marc Racicot, who was Bush's campaign manager, and White House general counsel Alberto Gonzales, who would give Bush a notable Hispanic appointment.

Also sometimes mentioned is former New York Mayor Rudolph Giuliani, but his spokeswoman said he's not interested. "Rudy Giuliani is not taking John Ashcroft's job," Sunny Mindel said.

Mindel said Giuliani is committed to the success of his business and government consulting firm.

Giuliani, a former prosecutor, is considered a possible presidential contender in 2008. Those political aspirations could be hampered by the controversies inherent in the top Justice Department job.

"Behind the Mask," Hannibal Lecter Prequel Coming

Producers Dino and Martha De Laurentiis have set British Director Peter Webber to direct "Behind the Mask," the Hannibal Lecter prequel being scripted by author Thomas Harris according to Variety.

The film will begin production in May for release in Summer 2006. Universal and MGM, partners on "Hannibal" and "Red Dragon," will get first crack at domestic rights. The British helmer of "Girl With A Pearl Earring" signed on just as the producers prepare to sell overseas rights this week at the American Film Market.

Author Thomas Harris surprised the De Laurentiises by asking to write the script as he scribbled the book. That is a first for Harris whose first draft has apparently enough material to yield two movies. They used it to hook Webber in.

Dino De Laurentiis says "It is a revenge story that shows why he became a cannibal,but he kills people that audiences want to see killed. So while there is a natural revulsion, the sympathy toward Hannibal remains...The first film can finish with his escape from France and then continue in the United States"

The producers and director will soon begin scouting locations in Lithuania, the Czech Republic and France. They will simultaneously search for young actors to play Lecter at three pivotal moments in his life.

Major and independent record labels today announced the first-ever retail availability of the much anticipated DualDisc — a two-sided disc made up of a CD player side and a DVD player side. A broad range of titles have begun to hit retail shelves in the first wave of products that will continue throughout the holiday season and into next year with releases from EMI Music, Silverline Records, Sony BMG Music Entertainment, Warner Music Group and Universal Music Group.

DualDisc is a new music product that combines audio and video content on a single disc. In addition to a full album on the CD player side, the DVD player side provides the full album in enhanced sound (such as Surround Sound and/or DVD-Audio or LPCM stereo), and also includes a wide range of special features and exclusive content such as music videos, interviews, photo galleries, web links, concert footage and lyrics.

Momentum has been building for DualDisc since the major and independent labels previewed the product for retailers at the National Association of Retail Merchandisers conference in San Diego in August.

"We are encouraged about the prospect of delivering a new type of music product that will offer fans an even richer music experience, and we believe that DualDisc will help to further drive traffic to retail," said Sue Peterson, Senior Buyer for the Music Department at Target. "I am hopeful that the record labels and artists will support new releases in DualDisc."

Music fans have also been anticipating the arrival of DualDisc. In test markets conducted earlier this year, consumers were overwhelmingly positive about the product. Some 90 percent said they would recommend DualDisc to a friend and 82 percent said they are satisfied or extremely satisfied with DualDisc.

As previously reported TKK has deparedt from the Evil Doer Tour 2004 after the Columbia, Missouri show on November 3rd. The tour will continue until December 10th in the States with Hanzel und Gretyl and Opiate for the Masses joining the band.

Steve Albini On Bands Signing To Major Labels

Tairrie B posted the following lesson by Chicago area producer Steve Albini on the MY RUIN website. I found it extremely interesting especially for those bands who are looking to sign to a major label. I've seen this happen to far too many bands, and a few of those bands were not beginners in the least, but seasoned pros. And about half of those bands I refer to consider me a friend and I them likewise.

For some of you it will be an eye opener. For others a bitter pill to swallow as a bad memory from the past which your certainly still taste in your mouth.

The Problem With Music by Steve Albini

Whenever I talk to a band who are about to sign with a major label, I always end up thinking of them in a particular context. I imagine a trench, about four feet wide and five feet deep, maybe sixty yards long, filled with runny, decaying shit. I imagine these people, some of them good friends, some of them barely acquaintances, at one end of this trench. I also imagine a faceless industry lackey at the other end holding a fountain pen and a contract waiting to be signed.

Nobody can see what's printed on the contract. It's too far away, and besides, the shit stench is making everybody's eyes water. The lackey shouts to everybody that the first one to swim the trench gets to sign the contract. Everybody dives in the trench and they struggle furiously to get to the other end. Two people arrive simultaneously and begin wrestling furiously, clawing each other and dunking each other under the shit. Eventually, one of them capitulates, and there's only one contestant left. He reaches for the pen, but the Lackey says "Actually, I think you need a little more development. Swim again, please. Backstroke. And he does of course.

I.A & R Scouts

Every major label involved in the hunt for new bands now has on staff a high-profile point man, an "A & R" rep who can present a comfortable face to any prospective band. The initials stand for "Artist and Repertoire." because historically, the A & R staff would select artists to record music that they had also selected, out of an available pool of each. This is still the case, though not openly.

These guys are universally young [about the same age as the bands being wooed], and nowadays they always have some obvious underground rock credibility flag they can wave. Lyle Preslar, former guitarist for Minor Threat, is one of them. Terry Tolkin, former NY independent booking agent and assistant manager at Touch and Go is one of them. Al Smith, former soundman at CBGB is one of them. Mike Gitter, former editor of XXX fanzine and contributor to Rip, Kerrang and other lowbrow rags is one of them. Many of the annoying turds who used to staff college radio stations are in their ranks as well.

There are several reasons A & R scouts are always young. The explanation usually copped-to is that the scout will be "hip to the current musical "scene." A more important reason is that the bands will intuitively trust someone they think is a peer, and who speaks fondly of the same formative rock and roll experiences.

The A & R person is the first person to make contact with the band, and as such is the first person to promise them the moon. Who better to promise them the moon than an idealistic young turk who expects to be calling the shots in a few years, and who has had no previous experience with a big record company. Hell, he's as naive as the band he's duping. When he tells them no one will interfere in their creative process, he probably even believes it.

When he sits down with the band for the first time, over a plate of angel hair pasta, he can tell them with all sincerity that when they sign with company X, they're really signing with him and he's on their side. Remember that great gig I saw you at in '85? Didn't we have a blast.

By now all rock bands are wise enough to be suspicious of music industry scum. There is a pervasive caricature in popular culture of a portly, middle aged ex-hipster talking a mile-a-minute, using outdated jargon and calling everybody "baby." After meeting "their" A & R guy, the band will say to themselves and everyone else, "He's not like a record company guy at all! He's like one of us." And they will be right. That's one of the reasons he was hired.

These A & R guys are not allowed to write contracts. What they do is present the band with a letter of intent, or "deal memo," which loosely states some terms, and affirms that the band will sign with the label once a contract has been agreed on.

The spookiest thing about this harmless sounding little memo, is that it is, for all legal purposes, a binding document. That is, once the band signs it, they are under obligation to conclude a deal with the label. If the label presents them with a contract that the band don't want to sign, all the label has to do is wait. There are a hundred other bands willing to sign the exact same contract, so the label is in a position of strength.

These letters never have any terms of expiration, so the band remain bound by the deal memo until a contract is signed, no matter how long that takes. The band cannot sign to another label even put out its own material unless they are released from their agreement, which never happens. Make no mistake about it: once a band has signed a letter of intent, they will either eventually sign a contract that suits the label or they will be destroyed.

One of my favorite bands was held hostage for the better part of two years by a slick young "He's not like a label guy at all," A & R rep, on the basis of such a deal memo. He had failed to come through on any of his promises [something he did with similar effect to another well-known band], and so the band wanted out. Another label expressed interest, but when the A & R man was asked to release the band, he said he would need money or points, or possibly both, before he would consider it.

The new label was afraid the price would be too dear, and they said no thanks. On the cusp of making their signature album, an excellent band, humiliated, broke up from the stress and the many months of inactivity.

II.There's This Band

There's this band. They're pretty ordinary, but they're also pretty good, so they've attracted some attention. They're signed to a moderate-sized "independent" label owned by a distribution company, and they have another two albums owed to the label.

They're a little ambitious. They'd like to get signed by a major label so they can have some security you know, get some good equipment, tour in a proper tour bus -- nothing fancy, just a little reward for all the hard work.

To that end, they got a manager. He knows some of the label guys, and he can shop their next project to all the right people. He takes his cut, sure, but it's only 15%, and if he can get them signed then it's money well spent. Anyways, it doesn't cost them anything if it doesn't work. 15% of nothing isn't much!

One day an A & R scout calls them, says he's been following them for a while now, and when their manager mentioned them to him, it just "clicked." Would they like to meet with him about the possibility of working out a deal with his label? Wow. Big Break time.

They meet the guy, and y'know what -- he's not what they expected from a label guy. He's young and dresses pretty much like the band does. He knows all their favorite bands. He's like one of them. He tells them he wants to go to bat for them, to try to get them everything they want. He says anything is possible with the right attitude. They conclude the evening by taking home a copy of a deal memo they wrote out and signed on the spot.

The A & R guy was full of great ideas, even talked about using a name producer. Butch Vig is out of the question-he wants 100 g's and three points, but they can get Don Fleming for $30,000 plus three points. Even that's a little steep, so maybe they'll go with that guy who used to be in David Letterman's band. He only wants three points. Or they can have just anybody record it (like Warton Tiers, maybe-- cost you 5 or 7 grand) and have Andy Wallace remix it for 4 grand a track plus 2 points. It was a lot to think about.

Well, they like this guy and they trust him. Besides, they already signed the deal memo. He must have been serious about wanting them to sign. They break the news to their current label, and the label manager says he wants them to succeed, so they have his blessing. He will need to be compensated, of course, for the remaining albums left on their contract, but he'll work it out with the label himself. Sub Pop made millions from selling off Nirvana, and Twin Tone hasn't done bad either: 50 grand for the Babes In Toyland and 60 grand for the Poster Children-- without having to sell a single additional record. It'll be something modest. The new label doesn't mind, so long as it's recoupable out of royalties (meaning the band pays the label back for "buying" them).

Well, they get the final contract, and it's not quite what they expected. They figure it's better to be safe than sorry and they turn it over to a lawyer --one who says he's experienced in entertainment law and he hammers out a few bugs. They're still not sure about it, but the lawyer says he's seen a lot of contracts, and theirs is pretty good. There'll be great royalty: 13% (less a 1O% packaging deduction). Wasn't it Buffalo Tom that were only getting 12% less 10%, too? Whatever.

The old label only wants 50 grand, an no points. Hell, Sub Pop got 3 points when they let Nirvana go. They're signed for four years, with options on each year, for a total of over a million dollars! That's a lot of money in any man's English. The first year's advance alone is $250,000. Just think about it, a quarter million, just for being in a rock band!

Their manager thinks it's a great deal, especially the large advance. Besides, he knows a publishing company that will take the band on if they get signed, and even give them an advance of 20 grand, so they'll be making that money too. The manager says publishing is pretty mysterious, and nobody really knows where all the money comes from, but the lawyer can look that contract over too. Hell, it's free money.

Their booking agent is excited about the band signing to a major. He says they can maybe average $1,000 or $2,000 a night from now on. That's enough to justify a five week tour, and with tour support, they can use a proper crew, buy some good equipment and even get a tour bus! Buses are pretty expensive, but if you figure in the price of a hotel room for everybody In the band and crew, they're actually about the same cost. Some bands, like Therapy? and Sloan and Stereolab) use buses on their tours even when they're getting paid only a couple hundred bucks a night, and this tour should earn at least a grand or two every night. It'll be worth it. The band will be more comfortable and will play better.

The agent says a band on a major label can get a merchandising company to pay them an advance on T-shirt sales! Ridiculous! There s a gold mine here! The lawyer should look over the merchandising contract, just to be safe.

They get drunk at the signing party. Polaroids are taken and everybody looks thrilled. The label picked them up in a limo.

They decided to go with the producer who used to be in Letterman's band. He had these technicians come in and tune the drums for them and tweak their amps and guitars. He had a guy bring in a slew of expensive old "vintage" microphones. Boy, were they "warm." He even had a guy come in and check the phase of all the equipment in the control room! Boy, was he professional. He used a bunch of equipment on them and by the end of it, they all agreed that it sounded very "punchy," yet "warm."

All that hard work paid off. With the help of a video, the album went like hotcakes! They sold a quarter million copies!

The band is now 1/4 of the way through its contract, has made the music industry more than 3 million dollars richer, but is in the hole $14,000 on royalties. The band members have each earned about 1/3 as much as they would working at a 7-11, but they got to ride in a tour bus for a month.

The next album will be about the same, except that the record company will insist they spend more time and money on it. Since the previous one never "recouped," the band will have no leverage, and will oblige.

The next tour will be about the same, except the merchandising advance will have already been paid, and the band, strangely enough, won't have earned any royalties from their T-shirts yet. Maybe the T-shirt guys have figured out how to count money like record company guys.

SCUM OF THE EARTH Tour Cancelled

SCUM OF THE EARTH, the new band formed by ex-ROB ZOMBIE guitarist Riggs, have been forced to cancel all remaining dates on their tour due to contractual discrepancies along the route. "We promise we will make it up to the fans very soon," Riggs said in a statement. "We would have done anything to keep the tour going, but it just wasn't possible under the circumstances." The group had just launched their tour in support of "Blah…Blah…Blah…Love Songs for the New Millennium", available now via Eclipse Records. Riggs recorded "Blah…" with an all-star cast of friends including drummer John Tempesta (WHITE ZOMBIE, ROB ZOMBIE, TESTAMENT, EXODUS) and his brother Mike Tempesta (guitar, POWERMAN 5000) — marking the first time the brothers have played together on record — SYSTEM OF A DOWN drummer John Dolmayan, as well as Clay Others (bass) and more. On tour, Riggs was due to flanked by former ADEMA guitarist Mike Ransom, POWERMAN 5000 drummer Adrian Ost and Others.
